Data Processing Addendum (DPA)

This DPA forms part of the User Service Agreement between NEW CORE TECH CO., PTE. LTD. ("3Chat") and the subscribing customer.

1. Definitions and Roles

The Customer is the Controller. 3Chat is the Processor. Agentic AI Data includes unstructured text, images, and voice notes processed to execute business goals.

2. Processing Instructions

3Chat processes personal data only on documented customer instructions, including revenue-first sales actions, MCP interactions with customer systems, and operation of the customer’s AI Agent.

3. AI Safety and Model Training Commitment

3Chat will not use customer data to train or improve general-purpose AI models or third-party foundation models. Data is used to optimize the customer’s own dedicated AI Agent.

4. Technical and Organizational Measures

• Logical isolation in a multi-tenant SaaS architecture
• Encryption at rest and in transit
• Restricted internal access for troubleshooting and support

5. Sub-processors

• Alibaba Cloud (Singapore): infrastructure and storage
• Alibaba Cloud Qwen: AI reasoning
• Stripe / Antom: subscription and transaction data

6. Data Subject Rights

3Chat provides tools so the Customer can respond to access or erasure requests under GDPR or CCPA.

7. Data Breach Notification

In a confirmed breach, 3Chat will notify the Customer without undue delay with information needed for legal notification obligations.

8. Termination and Deletion

Data is retained for 30 days after termination, then permanently deleted or anonymized unless required by law.
